Preserving the openness and freedom of the Internet is non-negotiable; it is a bedrock principle shared by all in the Internet economy. No government action is necessary to preserve it. Acting only on speculative concerns about network operators and contrary to a decade of industry practice, the FCC is moving forward aggressively without real evidence of systemic competitive harms to cure, markets to fix or consumers to help.

Robert Oppenheimer realized the country would need a new kind of weapons laboratory. This lab would maintain and improve the military’s arsenal rather than create new weapons. It would be called Sandia National Laboratories and placed not far from Los Alamos. Initially, the University of California ran the lab, but President Truman soon decided to transfer its operation to the entity he thought could best run it during the nascent cold war: AT&T. “In my opinion,” Truman wrote to an AT&T subsidiary in 1949, “you have here an opportunity to render an exceptional service in the national interest.” AT&T ended up running Sandia until the early 1990s.

So why, when they get an Apple iPhone or a BlackBerry Storm, are they signed up with a particular carrier? That's a question a lot of Americans ask when they travel overseas and find that the hottest devices can be used with any service. Their handsets are not only wireless, they also come without strings attached. The answer dates to the mid-1990s, when Congress and the Federal Communications Commission began siding with telecom companies, which wanted to build proprietary networks, unlike much of the rest of the world, which opted for open platforms. These days, the U.S. policy does not look like such a wise one.

In the next decades, it could well become the default regulator for every new communications technology, including, and especially, fantastic new ways to use wireless technologies, which today carry television, radio, internet, and cellular phone signals through the air, and which may soon provide high-speed internet access on-the-go, something that Google cofounder Larry Page calls "wifi on steroids."
