Consortium News - By Robert Parry - May. 26 (Editorial) - As Enron’s crisis worsened through the first nine months of Bush’s presidency, Lay secured Bush’s help in three key ways: --Bush personally joined the fight against imposing caps on the soaring price of electricity in California at a time when Enron was artificially driving up the price of electricity by manipulating supply. Bush’s resistance to price caps bought Enron extra time to gouge hundreds of millions of dollars from California’s consumers. --Bush granted Lay broad influence over the development of the administration’s energy policies, including the choice of key regulators to oversee Enron’s businesses. The chairman of the Federal Energy Regulatory Commission was replaced in 2001 after he began to delve into Enron’s complex derivative-financing schemes. --Bush had his NSC staff organize that administration-wide task force to pressure India to accommodate Enron’s interests in selling the Dabhol generating plant for as much as $2.3 billion.

Lay Convicted, Bush Walks

The Financial Criminal of the twentieth century, not long out of prison, meets with the Financial Criminal of the twenty-first century, who fears he may also have to do hard time. These two, bond-market manipulator Mike Millikin and Ken Lay, not-yet-indicted Chairman of Enron Corporation, were joined by a selected group of movers and shakers - and one movie star. Arnold Schwarzenegger had been to such private parties before. As a young immigrant without a nickel to his name, he put on private displays of his musculature for guests of his promoter. As with those early closed gatherings, I don't know all that went on at the Peninsula Hotel meet, though I understand Ahnold, this time, did not have to strip down to his Speedos. Nevertheless, the moral undressing was just as lascivious, if you read through the 34 page fax that arrived at our office.

Lay and Skilling Convicted: Ongoing Reaction

Professor Bainbridge - By Professor Bainbridge - May. 25 (Opinion) - The acquittal of Skilling on some of the insider trading counts suggests the jury approached the issues with an open mind, contrary to defense claims that they could not get a fair trial in Houston. It's not the crime, it's the cover up. The real crimes at Enron mainly consisted of turncoat government witness Andrew Fastow's shady deals, but Skilling and, especially, Lay are going down for improperly misrepresenting Enron's fortunes.
