What Supreme Court Justices really do.

Justices make choices, based largely, though not exclusively, on their political views of the issues involved. In reaching decisions this way, Justices aren't doing anything wrong; there is no other way to interpret the majestic vagueness of the Constitution. An underreported, but very important issue is discussed.

His comments make sense to and that is what I suspected, but nice to receive confirmation from a respected lawyer-commentator.
