The article provides balanced coverage of the nomination struggle. It is a bit horse-race oriented rather than going into any of the issues in depth. Feldmann suggests the lack of evidence will leave conservatives without a rallying point, but forgets that the radical right is not reality based and will rally with fear, lies, and bluster despite the lack of any evidence.

Given the last eight years, the question of limitations on presidential and corporate power should be the prime issues to examine.

This political observation is very well executed and delivered on the title. In this concise and very well written opinion is the equivalent of the old joke about how one gets to Carnegie Hall - Practice, Practice, Practice. In this case, Feldman implies (Judicial credentials notwithstanding) that the road to SCOTUS is Timing, Timing, Timing. She also points out, without disregarding impressive experience, that Sotomayor is not the sweetheart of the vociferous and activist Left and the GOP scuds are mostly thuds and part of a perfunctory thunder that most likely will not signal rain.

It's a good primer on why some liberals are nervous about Sonia Sotomayor, but I wish it would have given more information about specific cases she has ruled on.
