This was a brave article, if for nothing else, it asks a question - in the open. The one difficult spot in the article for me was the 'IF' paragraph (#5) which would have been fine if the article had a 6th paragraph that alternatively suggested - 'However, if' in order to present a different perspective -as long as they speculating on rationale it would have been more helpful had they suggested an alternative rationale, such as hanging crepe paper on the case so it would most definitely be in front of the USC, a venue that it was destined for in the first place.

The ramification of gaming any system, regardless of the intention, does have its shortcomings. I suspect when Congress learns to not re-draw Congressional districts to suit the majority party - cases such as this - distant siblings of such manipulation will become more and more relevant and replaced by advocates to promote education and training instead of throwing away test results. Asking Sotomayor to account for her decision, will no doubt be very interesting - even if it is a Right wing talking point.
