The opinion is built around a study from George Washington University. It cautions about the radical regressive effects of the amendment.

the study offers little hope that women who sign up for the public option will be able to find supplementary plans that cover abortion because there will be no market incentive for such plans to exist. And it can certainly be expected that supplementary plans, were they created, would find significant roadblocks to achieving harmony with the basic coverage plans that exclude abortion services.
