Harvard prof tells judge that P2P filesharing is "fair use"

Should Nesson win, he will essentially legalize the sharing of all digital goods, copyrighted or not, by noncommercial users. Given that he wants to make the case about big principles like fair use and the applicability of statutory damages—and not about whether Joel Tenenbaum did what he is accused of doing—the music industry is likely to fight even harder to ensure that Nesson's preferred outcome is not realized. A good look at the assault / reaction to assault upon copyright holders. In the digital age, a whole new set of copyrights neeed to be examined. This has been a long time coming, there has to be a fair understanding of what is and is not permissable. It has long been held that the non comercial use is fair use, to the end that recording a song off the airwabves was considered fair use, but selling that copy was a violation of the law.

This is but one of the many areas that need to be addressed, hopefully this will open the doors and shed light on some of the practices of the major holders and release payments to the minor holders.

Good preview of a contentious court-case.

I hope this works out for Nesson, but I'm not hopeful.

Wholesale copying of music on P2P networks is fair use. Statutory damages can’t be applied to P2P users. File-swapping results in no provable harm to rightsholders. More »
