The Supreme Court is in a tough spot in Caperton v. A.T. Massey. The legal claim here is that Americans have a due-process right to a judicial system untainted by the appearance or likelihood of bias. And appearances alone are sometimes enough. A little spicey and edgy, Lithwick looks at the supreme court trying to judge a judge who was bought and paid for by big business interests, and delivered.

One party's key constituency is the super rich. Perhaps the appointees from that party should recuse themselves from this supreme court case. Would we get a 4-0 decision? We need publicly financed elections, especially of judges.
